General terms and conditions

1. Definitions

For the purpose of these Terms and Conditions, the following terms have the following meanings:

• "Two Brizzly" means the commercial company Two Brizzly SRL, headquartered at str. Tineretului nr. 4, Chiajna, Ilfov, registered with the Trade Register under no. J23/8030/2023, CUI (Unique Identification Code) 49193907.
• "Site" means the website brizzly.ro and its subdomains, owned and managed by Two Brizzly.
• "User" means any natural or legal person who accesses and uses the Site.

2. Object

These Terms and Conditions establish the conditions under which Users may access and use the Site.

3. Access to the Site

Access to the Site is free.

Two Brizzly reserves the right to modify the structure and interface of any page of the Site at any time, having the right to temporarily or permanently interrupt, partially or totally, the services made available to the User through this website without prior notice.

4. Use of the Site

To use this site, it is necessary to read and accept these terms and conditions in their entirety. Visiting and continuing to use the site implies that you fully agree with the terms and conditions of use.

Any use of the Site that could infringe the rights of Two Brizzly or any third party is prohibited.

5. Use of the Site by persons under 18 years of age

The site is not intended for minors. Although they cannot be prevented from accessing the site, they do not have the right to send or post information on it, regardless of its nature. Any such operation must be carried out through the minor's legal representative. The legal representative is responsible for the minor's actions and may be held liable for any damage caused to the site or its owner.

6. Site Content

Two Brizzly holds all intellectual property rights over the Site's content, including texts, images, logos, and other elements on the Site. The site content may not be reproduced, copied, distributed, sold, transmitted, or published without the prior written consent of Two Brizzly.

Use of the Site's content without the prior written consent of Two Brizzly is prohibited.

7. Orders

Orders for products sold on the Site can be placed online, using the order form.

Receiving the email informing about the placement of an order does not constitute confirmation of the conclusion of the distance selling contract.

Two Brizzly reserves the right to cancel an order if the ordered product is no longer available, if there is an error in the price or description of the product, or if the User has not provided valid personal data (name, surname, address, email, phone, company, CUI, etc).

8. Product Delivery

Two Brizzly will deliver the goods to the buyer in Romania, via fast courier, to the address indicated by the buyer. Upon handing over the goods to the partner courier, the seller is no longer responsible for them. The seller will ensure that the goods are properly packaged and accompanied by the necessary documents.

The shipping cost for orders may vary depending on the weight and volume of the package. The User will be notified of any change in the shipping cost before the package is dispatched.

IMPORTANT: Orders outside the courier company's coverage area are subject to an additional shipping fee between 15 and 50 RON (depending on the number of additional kilometers).

Orders will be delivered in 1-4 working days via fast courier.

The shipping cost is borne by the User.

Cash on delivery involves an additional cost of 5 RON.

Orders over 300 RON benefit from free delivery.

9. Product Returns

Products can be returned within a maximum of 14 days from the date of receipt, only if they were damaged during transport. If the product was broken or damaged during transport, Two Brizzly assumes responsibility and will replace the product at its own expense (covering the costs of transport and product replacement) or refund the customer for the damaged or returned products. The returned product must contain the original packaging and show no visible signs of use. The refund will be made within a maximum of 30 days from the receipt of the return, using the same payment method used for the purchase (postal order for cash on delivery or card refund for card payment). Only the value of the product will be refunded, excluding shipping costs.

10. Product Warranty

All products sold by our company benefit from warranty conditions in accordance with the legislation in force provided by ANPC (National Authority for Consumer Protection) and the commercial policies of the manufacturers. Products sold on the Site benefit from the legal guarantee of conformity according to GEO 34/2014 and Law no. 449/2003.

11. Two Brizzly's Liability

Two Brizzly is not liable for:

• any damage caused to the User as a result of their failure to comply with these Terms and Conditions;
• any error or delay in product delivery;
• any non-conformity of the products with the specifications mentioned on the Site.

12. Modification of Terms and Conditions

Two Brizzly reserves the right to modify these Terms and Conditions at any time, without prior notification to the Users.

13. Force Majeure

Two Brizzly is not liable for the non-performance of its contractual obligations if these are caused by force majeure.

14. Disputes

Any dispute arising between Two Brizzly and the User will be settled amicably.

If an amicable settlement cannot be reached, the dispute will be settled by the competent court, in accordance with the Romanian laws in force.

15. Applicable Law

These Terms and Conditions are governed by Romanian legislation.
